OptiResonseTM is an intelligent patent prosecution tool that exponentially increases your chances of having patents granted in India.

Conventionally, a patent practitioner’s ability to overcome objections is limited by his individual knowledge, capacity to recollect and apply case law, style of drafting and time at hand to conduct research. The tool is developed to overcome such limitations with the belief that, the practitioner’s ability to overcome objections will be enhanced when assisted by bright minds who have succeeded in similar situations.

The tool is developed to bring this assistance with a few keystrokes. The tool provides assistance by intelligently suggesting a plethora of previously successful arguments for different types of objections raised in examination reports, before IPAB, High Courts and The Supreme Court of India 

These arguments have been collected and curated from prosecution history of 1000s of granted patents and cases. Hence, the tool comprises an intelligent aggregation of arguments made by patent practitioners across India, spanning across firms. Therefore, the tool enables a practitioner at InvnTree to develop superior arguments, with the “assistance” of several experts, wherein the arguments are otherwise constrained by his limitations.

Development of OptiResponse

OptiResonse is developed to retrieve curated content using a software platform, to empower the team at InvnTree to develop superior arguments to objections raised during prosecution of your Indian patent applications.  

The design of the tool began with development of a hierarchical Objection Classification System (OCS). OCSTM categorizes objections that are raised in examination reports issued by the patent office in India, in the lines of International Patent Classification.

Subsequently, prosecution history of 1000s of granted patents and cases were reviewed, and the objections and the corresponding arguments therein were assigned classes as per the OCS. The arguments have also been ranked based on various parameters, which include effectiveness to overcome the objection and current-ness. The arguments have also been assigned IPC classes based on the technical domain of the patent applications. The outcome of this human intensive exercise was transferred to our software platform for use by the team at InvnTree. The review and ranking exercise is carried out periodically to keep the tool updated.   

Using OptiResponse 

The team at InvnTree uses the tool to develop arguments while responding to examination reports. As an example, to develop arguments for an objection, a patent practitioner selects one or more classes of the OCS that may be relevant to the objection. The selected classes are used to query the tool. In response to the query, the tool provides a list of arguments that have been used previously to overcome similar objections. The arguments may be arranged as per the ranking previously assigned to them and also based on their current-ness. The list of arguments may be further narrowed down by one or more IPC classes based on the technical domain of the patent application being prosecuted. Hence, the list of arguments displayed are not just relevant to the objection raised, but also to the technical domain of the patent application.

The practitioner at InvnTree develops his arguments to overcome objections by considering arguments used by others, and their effectiveness in similar situations.

Conception of OptiResponse  

The idea behind OptiResponse was conceived by Mr. Kartik Puttaiah. He has a degree in Mechanical Engineering, and is a registered Indian Patent and Trademark agent. He is the CEO and co-founder of InvnTree.

Kartik found that, while some practitioners even within the most “reputed” firms deliver good quality, others within the same firm don’t. It was even more surprising to find that practitioners who were known for delivering good quality, underperformed from time-to-time. With much thought into this problem, he realized that the root cause for this inconsistency is attributable to the practitioner’s ability, which is limited to his individual knowledge, capacity to recollect and apply case law, style of arguing and time at hand to conduct research.

Kartik’s quest to overcome these limitations resulted in OptiResponse. With OptiResponse, the earlier discussed limitations are overcome, by empowering the team at InvnTree with readily retrievable relevant knowledge harvested from the brightest minds across India.
